The Context

BW Energy is developing Paradise Valley AI Campus in Humboldt County, northern Nevada, a 2,100-acre AI infrastructure campus anchored by a 500 MW behind-the-meter data centre. The power architecture combines a committed on-site natural gas plant, supplied via direct Ruby Pipeline access under a Vitol agreement at a Henry Hub discount, with a 750 MW solar and BESS offtake from an adjacent 10,000-acre site. Land expansion options extend the footprint by a further 4,700 acres to the north and south. The project was at early permitting stage when BW Energy commissioned a Nyxium assessment — the most consequential window in any infrastructure development cycle.

The Critical Finding BW Energy Did Not Know

Nyxium’s regulatory intelligence layer surfaced a material risk that was not on BW Energy’s radar at the time of engagement.

⚠ PROPOSED MORATORIUM — Humboldt County Board of Commissioners, May 18, 2026

The Board was scheduled to consider a first reading and public hearing on a temporary moratorium on data centre facilities within the unincorporated areas of Humboldt County. This is a proposed action not yet enacted but represents the highest-urgency regulatory risk on the project’s critical path. Immediate verification of adopted status and any grandfathering or vested-rights pathway is required before further capital commitment.

This was not an isolated signal. Nyxium’s assessment identified it as part of a broader and rapidly accelerating regional pattern:

  • Reno City Council voted 6–1 on May 14, 2026 to impose a 30-day moratorium on data centre construction permits, with a follow-up vote scheduled for June 1 to determine the length of a permanent moratorium.

  • Community opposition to data centres in Northern Nevada has intensified significantly in 2025–2026, with water use, noise, and grid capacity as the primary public concerns.

  • Nevada ballot initiative activity is underway, with Boulder City already advancing a data centre prohibition measure for the November 2026 ballot.

BW Energy was unaware of the Humboldt County moratorium item at the time of the assessment. Nyxium surfaced it from the May 18 Board agenda, days before it became public knowledge, enabling BW Energy to seek legal counsel and verify grandfathering options before any regulatory filing.

Other Key Findings

Water rights — the real critical path

Nevada operates under prior appropriation water law. BW Energy had secured 800 acre-feet of rights, but a further 4,000 AFA remained in adjudication, unresolved and not guaranteed. Nyxium identified water rights as the single longest-lead permitting item (9–12 months), recommended a Phase II hydrogeological study, and flagged early NDEP engagement as essential before any other regulatory filing.

The BTM structure is a regulatory advantage

Nyxium confirmed that Nevada’s NRS 704.021 explicitly excludes behind-the-meter data centre power equipment from utility regulation, eliminating PUCN interconnection approvals and grid-dependent constraints. This is not a commonly understood provision. Its correct application to the Paradise Valley structure required specific regulatory analysis that Nyxium ran as part of the assessment.

The Ruby Pipeline access is a genuine permitting advantage

Nyxium’s natural gas analysis confirmed the 42-inch Ruby Pipeline adjacency as a material permitting advantage, avoiding the most complex approval pathway (new lateral build-out) by connecting to an established interstate corridor. The North Valmy coal-to-gas conversion and the approved Pinyon Pipeline provide direct local precedent for this structure.

Solar figure inconsistency flagged

Nyxium identified an internal inconsistency in the site documentation: the project body text cited 750 MW solar + BESS, while the site map caption showed 600+ MW. This discrepancy reflected an evolving offtake negotiation. Nyxium flagged it as requiring resolution before any regulatory filing, to avoid credibility risk in PUCN or county proceedings.

Seismic risk requires further investigation

The nearest fault is 354 metres from the site — notably close for a 500 MW critical infrastructure facility. Nyxium flagged this as requiring a Phase II geotechnical investigation including seismic microzonation and Peak Ground Acceleration modelling before construction design is finalised.

The Outcome

BW Energy received a fully integrated site intelligence package covering every regulatory, engineering, and community acceptance dimension of the project before committing further capital. The moratorium discovery alone justified the entire engagement: a developer proceeding without that intelligence could have filed applications, triggered public hearing processes, and committed legal resource into a jurisdiction actively considering a data centre ban. Nyxium identified the risk in time to act on it.
